Terms and Conditions – FIL Alpin

Please read these Terms and Conditions (“Terms”) carefully before using the booking services offered on the FILAlpin.ch and FILAlpin.com websites (the “Service”) and participating in any snowsport activities.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By making a booking, you agree to be bound by these Terms.
Your use of our Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review our Privacy Policy to understand our practices.
- Definition of Roles and Parties
“FIL Alpin” refers to the brand and trading style which markets snowsport activities and acts as a booking and payment agent.
The “Partner Snowsport School” or “Partner Snowsport Instructor” refers to the local, independent, and fully licensed snowsport school entity or individual professional that is regulated, authorised, and insured to operate and supervise all snowsport lessons, guided tours, and other on-snow activities.
The “Client” refers to any person or persons making a booking through the Service.
Activities are marketed to the general public by “FIL Alpin”. All on-snow activities are exclusively operated by the Partner Snowsport School or Partner Snowsport Instructor, which operates under a formal partnership agreement with “FIL Alpin”.
For the avoidance of doubt, FIL Alpin is not a snowsport school and does not directly employ snowsport instructors or operate snowsport activities. The Service functions exclusively as a technology platform and agent that facilitates the booking of services rendered by the independent Partner Snowsport School or Partner Snowsport Instructor.
You acknowledge and agree that FIL Alpin is a technology platform that enables You (The “Client”) to request and conclude booking transactions in respect to on-snow activities and related services listed on the Site and, consequently that FIL Alpin is not itself a party to any booking transaction and disclaims all liability arising from or related to any such transactions to the fullest extent permitted by law. The role of FIL Alpin is solely to facilitate the availability of the Site and the Booking, acting as a payment agent for and on behalf of our partner(s). We do not purchase, sell, provide, control or manage in our own name for the provision of any activity listed on the Site nor related services including, but not limited to, on-snow activities and transportation. We, as FIL Alpin, are not supplying and cannot supply such activities or services to Clients.
- Booking and Payment
2.1. To secure a booking for a snowsport lesson, guided tour, or any other activity, the Client must complete the booking process through the Service.
2.2. All prices are quoted in Swiss Francs (CHF) unless otherwise stated.
2.3. The amount paid online at the time of booking is non-refundable and constitutes the cost of membership with FIL Alpin, a member-only collective. This membership grants the Client access to book and participate in the activities operated by the Partner Snowsport School or Partner Snowsport Instructor. This fee covers administrative, marketing, and booking agent costs.
- Cancellations
3.1. Cancellation by the Client: As the online payment constitutes a non-refundable membership fee, no refunds will be issued for cancellations made by the Client for any reason, including but not limited to, change of plans, personal injury, or illness prior to the activity. We strongly recommend that all Clients purchase comprehensive travel and cancellation insurance. If the activity was not paid in full and cancelled less than 7 days prior to the start time, the Client remains liable for the full payment of the activity at the agreed price. We always recommend to buy appropriate cancellation insurance and do provide confirmations for your insurer on request.
3.2. Cancellation by the Partner Snowsport School, Partner Snowsport Instructor, or FIL Alpin: In the unlikely event that the activity must be cancelled due to unforeseen circumstances, such as extreme weather conditions where all ski lifts in the designated area are closed, instructor illness, or other safety concerns, the Client will be offered one of the following: a) The opportunity to reschedule the activity to a mutually convenient date and time. b) A credit note for the value of the activity, valid for 12 months.
3.3. No-Shows: If the Client fails to arrive at the agreed-upon meeting point at the scheduled time, the lesson or tour will be considered a “no-show,” and no refund or credit will be provided. If the activity was not paid in full prior to the start time, the Client remains liable for the full payment of the activity at the agreed price.
- Client Obligations
4.1. The Client is responsible for ensuring they have adequate and valid insurance coverage for the activity being undertaken, including but not limited to, winter sports insurance that covers mountain rescue, medical expenses, and third-party liability.
4.2. The Client must ensure they are in suitable physical condition to participate in the booked activity. Any medical conditions or concerns must be communicated at the time of booking.
4.3. The Client must have appropriate and safe snowsport equipment (skis, snowboard boots, poles) and clothing for the prevailing mountain conditions. Helmets are strongly recommended. For off-piste activities, a beacon, shovel, probe and backpack are required for participation.
4.4. The Client agrees to follow the instructions of the snowsport instructor or guide from the Partner Snowsport School or Partner Snowsport Instructor at all times. The instructor reserves the right to terminate a lesson or tour if a Client’s behavior is deemed unsafe or disruptive to the group, with no refund provided.
- Liability and Insurance
5.1. Snowsport and other winter sports are inherently dangerous activities. Participation is at the Client’s own risk.
5.2. The Partner Snowsport School or Partner Snowsport Instructor is fully licensed and holds their own public liability insurance for all on-snow activities they operate. “FIL Alpin” acts solely as a marketing and payment agent and holds no liability for any accidents, injuries, losses, or damages that may occur during the on-snow activities supervised and operated by the Partner Snowsport School or Partner Snowsport Instructor.
5.3. “FIL Alpin” is not responsible for any loss or damage to the Client’s personal property during the activity.
- Intellectual Property Rights: Copyright and Trademark
6.1. Ownership of Content and Trademarks: All content, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, available on the “FIL Alpin” website and any accompanying materials (“Content”) is the property of “FIL Alpin” or its content suppliers and is protected by international copyright laws.
The name “FIL Alpin”, its logo, and any other trademarks, service marks, graphics, and logos used in connection with the service are trademarks or registered trademarks of “FIL Alpin” or its licensors. All other trademarks not owned by “FIL Alpin” that appear on the service are the property of their respective owners.
6.2. Restrictions on Use: Your use of the “FIL Alpin” service and its Content is for personal and non-commercial use only. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and make personal use of the service. Any unauthorized use of the Content or the “FIL Alpin” trademarks is strictly prohibited. You agree not to:
- Reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purpose the “FIL Alpin” service or any of its Content without express written consent from “FIL Alpin”.
- Use any “FIL Alpin” trademark, logo, or other proprietary information, including the images found on the service, the content of any text or the layout/design of any page, without our express written consent.
- Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the service or its Content.
- Remove any copyright, trademark, or other proprietary rights notices contained in or on the “FIL Alpin” service.
6.3. User-Generated Content: In the event that users are permitted to post content on the “FIL Alpin” platform, you grant “FIL Alpin” a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify “FIL Alpin” for all claims resulting from content you supply.
6.4. Infringement Notification: “FIL Alpin” respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide us with the following information:
- A description of the copyrighted work or other intellectual property that you claim has been infringed.
- A description of where the material that you claim is infringing is located on the site.
- Your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
- General Provisions
7.1. These Terms and Conditions shall be governed and construed in accordance with the applicable law.
7.2. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
